AES Export Processing for U.S. Customs & Border Protection

Dear Valued Customer:
We are writing to update you on the important changes to the shipment processes arising from the implementation of the new AES Rule, effective September 30, 2008. This will be applicable for all cargo on vessels that load at ports in the United States.
Introduction of new ITN cut-off
- Effective September 30, 2008, US Principle Party in Interest (USPPI) must provide their ocean carrier partners either the ITN provided in response to their AES filing with US Census or written notification of their exemption/exclusion status on an individual Bill of Lading basis. This will have to be submitted before the ITN cutoff, which is 24 hours before Port CY cut-offs.
- ITN cut-off applies to dry and reefer cargo.
- The ITN, exemption and exclusion legend must conform to the new regulations
- For example, a valid Exemption Legend prior to September 30, 2008 would be ‘NO SED 30.55 (b)'. However, after September 30, 2008, it would become NOEEI 30.55 (b).
- Other valid ITN declarations would include AES X2008123456789 or AES POST 123456789-987654321 10/1/08.
Channels for submission of ITN
USPPI will be able to submit ITN/exemption/exclusion legend to APL on and after September 30, 2008 in the following ways:
- By fax (Fax: +1-800-678-3687).
- By web submission. Log on to the APL HomePort portal and simply click on the “US Export ITN” button.
- By EDI using 300 (Booking) or 304 (Shipping Instructions) message.
- Note the USPPI must use the N9/ED segment in the 300 message or use N9/ED (preferred) or C8/38 segment in the 304 message.
No Doc/No Load cut-off to remain in effect
- No Doc/No Load cut-off will remain unchanged for cargo relayed or destined for ports in Brazil, Guatemala, El Salvador, Honduras, Nicaragua, Mexico and Canada.
Roll Fee
- Failure to provide ITN/exemption/exclusion legend timely adversely impacts the planning, handling, stowing and loading operations at terminals. Therefore a roll fee will be applied when cargo has to be rolled due to the absence an ITN/exemption/exclusion legend.
- The fee will be US$200 per dry or reefer container on Transpacific trade and US$50 for the Transatlantic and Latin American trades.
- In addition, handling charges incurred as a result of the cargo being rolled will be added onto the Bill of Lading.
